This document is provided to Users who have joined, on a voluntary basis, the services and products offered by Hale. These Terms and Conditions govern access to the eligibility and framing questionnaires of the User's needs and the provision - upon purchase and creation of a personal profile - of video, audio and text content prepared by Hale ("Services" or "Products"). These Terms and Conditions therefore constitute a legally binding agreement between the User and Hale. Please read these Terms and Conditions carefully before proceeding to accept them.
For the purposes of this document, the following terms shall have the meanings ascribed to them below:
Personal data: personal information concerning the User, within the meaning and effect of the definition contained in Article 4(1) of EU Regulation no. 679/2016, i.e. "any information relating to an identified or identifiable natural person ("data subject"); an identifiable natural person is one who can be identified, directly or indirectly, by reference in particular to an identifier such as a name, an identification number, location data, an online identifier or to one or more characteristic elements of his or her physical, physiological, genetic, mental, economic, cultural or social identity."
Special Data: personal information revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, as well as dealing with genetic data, biometric data intended to uniquely identify a natural person, data relating to a person's health or sex life or sexual orientation.
Health-Related Data: the Personal Data pertaining to the physical or mental health of a natural person, including the provision of health care services, that reveal information relating to his or her health status;
Scientific Professional(s) or Advisor(s): the qualified health professionals that Hale uses to prepare and review the video, audio and text content offered to Users. Specifically, Hale employs the support of female professionals specializing in sexology and psychotherapy.
Services or Products:
a) Eligibility Questionnaire, aimed at verifying the basic requirements to make the best use of Hale's Services and Products.
b) Framing Questionnaire of the User's symptoms, areas of interest and lifestyle habits, aimed at identifying the User's needs and the consequent customization of the content and materials to be provided to him/her.
c) Personalized video, audio and textual content directed at improving daily pain management at the psychological level and shared with the User, subject to purchase and creation of a personal profile. Such content is produced by Hale, based on evidence and/or scientific techniques and subject to review by Professionals.
d) Content for purely informational and/or educational purposes.
e) Platform for interaction with other patients participating in the service, in single and group modes. Excluding the intervention and support of Professionals specialized in sexology and psychotherapy, Hale's Services or Products do not present any diagnostic purposes and are, therefore, not equivalent to medical examinations and/or clinical therapies. Personal Data Protection Legislation: means the EU Regulation No. 2016/679 (hereinafter also "GDPR"), the Privacy Code, as recently amended by Legislative Decree 101/2018 and any measure and/or guideline adopted by the Italian Data Protection Authority, as well as any regulatory provision for time applicable to the protection of personal data.
User: means the person who uses the Services or Products of Hale, as described above.
Hale is an initiative that was created with the aim of centralizing information about pelvic floor dysfunction and chronic pelvic pain, dispelling taboos about it, and raising awareness about it at the health and social levels. Hale aims to offer personalized pathways of psychological support intended for women of age with pelvic floor dysfunction through the completion of two questionnaires (eligibility and needs customization) prodromal to the delivery of video, audio, and textual content ("Services" or "Products") and compilable through the Typeform platform. Hale content provided to the User is intended solely to improve the User's condition by providing psychological support in the management of pain caused by pelvic floor dysfunction. The User is, therefore, aware that the use of Hale's Services and Products - although they are prepared on the basis of scientific evidence and the support of Health Professionals - cannot be considered in any way a substitute for a medical examination, which, scientifically, represents the only diagnostic and therapeutic tool. All individuals over the age of 18 are eligible for Hale's Services and Products. For minors, it is currently not possible to join the service.
The User agrees to use the Services with diligence, in compliance with the provisions of these Terms and Conditions, including its subsequent amendments and additions, as well as in full compliance with the provisions of applicable laws and regulations.
The User acknowledges that Hale may not be held liable in any way for criminal, civil and administrative torts committed by the User by means of the Services, including to the detriment of third parties, and agrees to indemnify and otherwise hold Hale harmless from any action, claim, demand, cost or expense, including reasonable legal fees, that may be brought by third parties due to the User's failure to comply with the obligations assumed and the guarantees given by acceptance of these Terms and Conditions.
Pursuant to and for the purposes of Article 1456 of the Italian Civil Code, Hale reserves the right to terminate this contract for non-performance in the event of a breach by the User of the provisions set out therein, without prejudice to the rights of the same to compensation for any damages suffered.
Hale reserves the right, in cases of particular seriousness and urgency, to suspend or interrupt the provision of the Services even without prior notice to the User in cases where it detects elements from which it appears that the manner of use of the Services by the User may, directly or indirectly, cause damage to Hale or third parties as well as compromise the stability, security and quality of the Services offered, without prejudice to Hale's right to compensation for damages.
Hale is in no way responsible for information, including Personal Data and Special Data, communications and content transmitted directly by the User to third parties.
The Services and Products and related material are the property of Hale, unless otherwise indicated; Italian, German and European copyright laws apply to it. Reproduction, even in part, of the Services and Products, without the prior permission of Hale, is prohibited.
For the purpose of providing the Services, Hale, in compliance with the Personal Data Protection Legislation, processes as Data Controller the User's Personal Data, including Common Data and Special Data. Special Data and, specifically, Health Data will be processed by the Data Controller after obtaining the consent, freely expressed, from the User, for the purposes and according to the modalities described by Hale within the information on the processing of personal data provided pursuant to Article 13 of the GDPR.
The Personal Data communicated by the User, when filling in questionnaires and delivering personalized content, will not be transferred in any way to third parties, except to Hale's suppliers duly appointed as Data Processors pursuant to Article 28 of the GDPR.

Hale reserves the right to make changes to both the Services and Products and these Terms and Conditions at any time by bringing them to your attention via the email address shared when completing the eligibility questionnaire.
